TIE Card Spain - Legal Tips

Instruction of 2nd July has changed the procedure for issuing the residence document for citizens of the United Kingdom of Great Britain and Northern Ireland nationals.

On 31 January 2020, the United Kingdom ceased to belong to the European Union, but the Agreement provides for a transitional period lasting, in principle, until 31 December 2020.

Let’s see now what exactly the tie card in spain is and how to get it.

What is a tie card in Spain?

The TIE card is the “Tarjeta de Identificación de Extranjeros” (foreigner identity card). It is the identification document that contains details of the identity of foreigners in Spain.

It also serves as proof that the holder has been granted a residence permit in the country for a certain period of time. Among the information that can be found on the TIE card is the NIE number and the status of the holder in the country.

How to get a TIE card in Spain

Therefore, those who have exercised their right to reside or work in accordance with Union law before the end of the transitional period and who continue to do so after that period, will have exactly the same rights as those who have exercised their right to reside or work in accordance with Union law.

Those who arrive after the end of the transitional period and who are not included in it, will be considered third country nationals and, without prejudice to the application of a special regime for future mobility, will be subject to the provisions of the general regime for foreigners.

United Kingdom nationals, their family members and any other persons residing in Spain, under the conditions set out in the Agreement, will not be required to apply for a new resident status, or be subject to a new documentation process, but will be entitled to receive a residence document, expressly stating their status, as a beneficiary of the withdrawal Agreement.

The deadline for submitting the application if are doing it for the FIRST TIME shall be three months from your arrival in Spain, or from the date of birth. If you are already in possession of it, you do NOT have the obligation to exchange.

How to apply for a tie card in spain

The procedure for obtaining this residence document depends on whether the United Kingdom national holds a residence certificate, either temporary or permanent; or does not hold such a certificate, because they did not apply for it beforehand.

Depending on the situation of the United Kingdom national, obtaining the TIE card residence document will require either step one (at the authorised police stations) or step two (at the Immigration Office and then at the authorised police station).

1. If the United Kingdom national is the holder of a temporary residence certificate and has not reached 5 years’ legal residence in Spain, they may apply for residence in person at the police station. This residence document will be valid for 5 years and the term “Temporary” will be indicated.

2. If the United Kingdom national is the holder of a temporary residence certificate and has reached 5 years of legal residence in Spain, they may apply in person to the police, after verification of the duration of residence will issue it.  This residence document will be valid for 10 years and in the field corresponding to the Type of Permit the term “Permanent” will be indicated.

3. If the United Kingdom national is the holder of a permanent residence certificate, they may apply in person at the police station. The TIE card Spain residence document will be valid for 10 years and in the field corresponding to the Type of Permit the term “Permanent” will be indicated.

In these 3 cases at the time of application of the residence document at the police station, the citizen concerned must provide the following documentation:

  • Valid and current passport  (original and fotocopy of data page)
  • In case of change of address certificate of registration  from the Town Hall, no older than three months
  • 1 photo
  • Proof of payment of the corresponding fee (model 790, code 012)
  • Application form -EX 23
  • EU citizen’s registration certificate (original and fotocopy)

4. If the United Kingdom national does not hold a residence certificate, they may apply for this residence document in person or through their representative at the immigration office of the province in which they reside or intend to take up residence, or by electronic means. Once this has been granted, they must go to the police station that is authorized to issue the document.

The following documentation must be provided at the time of application before the Immigration Office:

1. Passport complete 
2. EX20 application form  
3. Certificate of registration 
4. NIE (if you have one) 
 
In the case of pensioners 
  • S1 form from your country’s social security/health department 
  • Spanish bank certificate showing the minimum balance and  payments made in Spain over the last 3 months 
In the case of non-pensioners and non-working: 
  • Private medical insurance 
  • Spanish bank certificate showing the minimum balance and  payments made in Spain over the last 3 months 
Minimum balance in account (during last 3 months prior to appointment) 
  • 1 person – 9.000 euros 
  • 2 persons – 18.000 euros 
  • For each extra adult in the family unit another 9.000 euros per person 
  • For each child in the family unit 4.500 euros per child 
In case of persons in employment : 
  • Up to date working life certificate with a minimum of 50% of the legal working hours. 
  • Work contract. 
  • Proof of income of a minimum of 750 € euros per month 
In case of self-employment (autónomos): 
  • Up to date working life certificate  (you must have been registered for a minimum of 3 months) 
  • Forms “Modelo 036 or 037” 
  • Modelo 130, in box 03 of the form, there must be an amount of 750 € per month (minimum) 750 € multiplied by the months that you have been registered during this year.

If the application meets the requirements, the decision on the residence document will be issued and notified within a maximum period of three months.

Within one month of notification of the decision on the residence document, you must apply in person for it to be issued before the police unit and provide the following documentation:

  • Valid and current passport  (original and fotocopy of data page)
  • EU citizen’s registration certificate (original and fotocopy)
  • Application form -EX 23
  • Proof of payment of the corresponding fee (model 790, code 012)
  • 1 photo
  • In case of change of address certificate of registration  from the Town Hall, no older than three months

This residence document will be valid for 5 years in the case of residences that are less than 5 years old and, therefore, the term “Temporary” will be indicated; and for 10 years in the case of residences that are more than 5 years old and, therefore, the term “Permanent” will be indicated.

Administrative procedures initiated before 6 July, concerning the acquisition of registration certificates by UK nationals and residence cards for family members of UK nationals who are Union citizens, will be processed and resolved in accordance with these instructions.
