Who is considered a consumer or user?

A consumer or user is any individual or legal entity who acquires or uses goods or services as the final user, meaning for personal use rather than for incorporation into a business or professional activity. This legal protection applies when products or services are purchased for personal consumption, but it generally does not apply when they are acquired for commercial, business, or professional purposes.

Main consumer rights

Right to health and safety protection

Right to protection of economic interests

Right to clear and accurate information

Right to compensation for damages

How to file a consumer complaint in Spain

Complaint directly to the company

The first step is usually to submit a complaint directly to the company responsible, typically through its customer service department.

In many cases, the issue can be resolved quickly through this initial communication

Official complaint forms

Businesses open to the public in Spain are required to provide official complaint forms, which allow consumers to formally report a problem to consumer protection authorities.

Court proceedings

If the dispute cannot be resolved through other channels, consumers may pursue legal action before the courts to claim:

  • fulfilment of contractual obligations
  • reimbursement of amounts paid
  • compensation for damages
  • cancellation of unfair contractual clauses

Complaint directly to the company

Consumers may also file a complaint with public authorities such as:

  • Municipal Consumer Information Offices (OMIC)
  • Regional Consumer Services of the autonomous community

These authorities can investigate and impose sanctions if the company has breached consumer protection regulations.

Consumer arbitration

The Consumer Arbitration System is an out-of-court mechanism designed to resolve disputes between consumers and companies quickly and efficiently when both parties agree to participate.

It is generally free of charge and results in a binding decision.
