The preliminary ruling
The preliminary ruling procedure allows national judges to consult the Court of Justice of the EU to ensure uniform application of European law and verify the compatibility of national legislation. Proceedings before the CJEU are public, and the interpretation it issues is binding on the referring court and other courts in substantially similar cases.
What resources can we assist you with?
The action for failure to comply
It enables the Court of Justice to monitor whether Member States are complying with their obligations under EU law.
The appeal for annulment
By means of this action, the applicant seeks the annulment of an act of an institution, body or agency of the Union (in particular, regulations, directives, etc.).
The appeal by omission
It allows for the legality of the inaction of an institution, body or agency of the Union to be reviewed. However, this remedy cannot be invoked before the institution has been requested to act.
Appeal proceedings
Proceedings before the European Court of Justice are free of charge, but the parties must be represented by a European solicitor authorised to practise before a court in a Member State.
