The General Data Protection Regulation (hereinafter, RGPD), published in May 2016 and applicable as of 25 May 2018, is a regulation with immediate application to the entire European Union, with regard to the protection of individuals concerning processing of personal data and free movement of data.
Therefore, it is important that in the event of carrying out an activity, the new requirements and readjustments added are brought forward, with respect to the assurance and protection of personal data, which have tightened the protocols and raised the sanctions, overall agreeing to a greater protection that affects to a greater extent certain professional groups.
The new regulation, broadly speaking, promotes the principle of a proactive responsibility, for which the person in charge alone must apply sufficient measures (technical and organisational) to guarantee and demonstrate that the process is in accordance with the regulation at all times, being key for example, the regular audit to call for a consistent maintenance always.
The most important thing is that linearly, within its activity, we can demonstrate that the measures have been and remain adequate, with utmost diligence in the use, treatment, disclosure, storage, etc. of personal data, from customers, employees and suppliers, when requested by interested parties and supervisory authorities. These measures, which are modulated according to the level and type of risk that the handling or data represent, must however adapt to the needs and characteristics of the companies or professionals.
